WIN A FERRARI EXPERIENCE AT EXOTICS RACING

The Win a Ferrari Driving Experience at Exotics Racing Contest (the “Contest”), sponsored by Dreamdealers USA LLC dba Exotics Racing (“We”; “Us”; “Exotics Racing”; and/or “Sponsor”) begins on December 27, 2017, at 12:00 a.m. and ends January 2, 2018, at 11:59 p.m. (the “Contest Period”). The following Contest rules (the “Rules”) govern the Contest and, by participating in the Contest, you (“You” and/or “Entrant(s)” agree to be bound by these Rules and the decisions of the Sponsor. Void where prohibited by law.

NO PURCHASE NECESSARY TO ENTER OR WIN

Contest is open to all legal residents of the United States who have reached the age of majority in their respective state of residence at the time of Photo (19 years of age if a resident of Alabama, 18 in all other states). Employees, agents, or contractors of Exotics Racing, and spouses, immediate family members of, and any persons who reside with any such employees, agents or contractors, are not eligible to enter.

How to Play: Take a photo with Exotics Racing’s Gold Ferrari and post it on Instagram, during the Contest Period, using the hashtag #EXOTICSRACING (each a “Photo”). Once the Contest Period has ended, Exotics Racing will choose its favorite Photo and post it to Exotics Racing’s Instagram account (@exoticsracing). The winner will receive a free 5-lap driving experience at Exotics Racing in a Ferrari 430, on a time and date to be determined, according to availability at Exotics Racing’s track, located at 6925 Speedway Blvd, Las Vegas, NV 89115 (the “Prize”).

Odds of Winning: One winner will be chosen, and the odds of winning will depend on the number of Photos received. Only one Photo per person is permitted and anyone found to be using multiple accounts to enter will be ineligible. In the event of a dispute, the holder of the account posting the winning image will be deemed the Prize winner. The Prize winner will be notified via a direct message to his or her Instagram account and will have forty-eight (48) hours to respond to the message and accept the prize. If no response is received within forty-eight hours, another winner will be chosen.

Social Media and Photos: Your Instagram profile and posts must be PUBLIC in order for us to see your posts and for you to be eligible. All Contest Photos must be original works of authorship, and by entering the Contest, Entrants represent and warrant that the Photo does not violate any third party’s intellectual property rights. Exotics Racing reserves the right to disqualify any Photos which do not abide by these Rules.

By posting your Photo and tagging Exotics Racing, you are granting Exotics Racing a limited right of publicity in your name (first and last initial only), image, and likeness to be used in association with the promotion of the Contest. Exotics Racing reserves the right to publish your first name and last initial, in connection with the winning Photo, on Exotics Racing’s social media pages, including Instagram, Facebook, and Twitter, as well as the Exotics Racing website, located at www.exoticsracing.com. This Contest is in no way sponsored, endorsed or administered by, or associated with, Instagram, Facebook, or Twitter. Only posts on Instagram will be considered entries in the Contest.

Retail Value and Driving Experience Information: The Approximate Retail Value of the Prize is $299.00 USD. The winner will be expected to comply with all track policies and procedures, including executing any liability waivers required for participation in Exotics Racing Driving Experiences. Choice of Law and Indemnification. The Rules and the Contest are to be governed in accordance with the laws of the State of Nevada. Any and all claims or disputes arising out of or in relation to the Contest shall be resolved by the state and/or federal courts sitting in Clark County, Nevada.

By participating in the Contest, you agree to defend, indemnify and hold harmless Exotics Racing (and its officers, directors, agents, subsidiaries, joint ventures, employees and third-party service providers), from all claims, demands, losses, liabilities, costs, expenses, obligations and damages including reasonable legal fees, arising out of (a) the Contest; (b) your violation of any term of these Rules; (c) a breach of your representations and warranties set forth above regarding your Photo; (d) your violation of any law or the rights of a third party (including, without limitation, any copyright, property or privacy right); or (e) any claim that any Photo you submitted caused damage to a third party. This indemnification obligation will survive the termination of these Rules and the Contest Period.
